Suspended Chief Justice Sues Ghana at ECOWAS Court

Suspended Chief Justice of Ghana, Her Ladyship Justice Gertrude Torkornoo has sued the Republic of Ghana at the ECOWAS Community Court of Justice in Abuja, Nigeria.
According to Deputy Attorney General Justice Srem-Sai, who disclosed the development on his official Twitter page, the case was filed on July 4 and contains the same allegations of human rights violations already pending before Ghana’s Supreme Court and High Court.
These allegations stem from the controversial process initiated to remove her from office.
“I can confirm that the Chief Justice – Her Ladyship, Justice Gertrude Torkornoo – has filed another court case – this time, at the ECOWAS Community Court in Abuja, Nigeria, against the Republic,” Srem-Sai noted.
“Essentially, Her Ladyship argues that by her suspension, she has effectively been removed from her official capacity without a final determination, impairing her right to function and serve in a position she was constitutionally appointed to. Da yie.”

This latest move comes just days after Justice Torkornoo publicly addressed the circumstances surrounding her suspension for the first time.
At a press conference held in June, she raised serious constitutional and procedural concerns about the process, particularly questioning the legality of the prima facie case established against her and the secretive nature of the proceedings.
In her statement, the embattled Chief Justice described the in-camera hearing as “fundamentally unconstitutional,” insisting that such matters of public interest should not be shrouded in secrecy.
She disclosed that she had already filed an application at the Supreme Court seeking a public hearing in the interest of transparency and judicial accountability.
However, according to her, that request was turned down by the government.
“I have filed an action in the Supreme Court requesting that my hearing be conducted publicly,” she said. “But the government declined that request.”
All signs suggest that Torkornoo is not willing to relinquish her position without a fight.
I’m tempted to believe that the NPP, the party under which she was appointed, is supporting her in tto take this down to the wire , allowing her to remain in her role to serve their interests.
